Terms of Service
The rules of using ZUMI.
These Terms of Service ("Terms") govern your access to and use of ZUMI ("ZUMI", "we", "us", "our"), a conversational AI wellbeing companion offered through messaging platforms (currently WhatsApp and Telegram, with iMessage planned) and through the website and dashboard at meetzumi.com. By using ZUMI you accept these Terms in full. If you do not accept them, do not use ZUMI.
Beta notice. ZUMI is in private beta. The service is experimental, may behave unexpectedly, may be slow, may lose data, and may be modified, suspended, or discontinued at any time without notice. By using ZUMI in beta you acknowledge and accept these risks.
1. Who provides ZUMI
ZUMI is operated from Italy. During the private beta the service is run by a private individual residing in Italy. Full identity details are provided upon any legitimate request to info@meetzumi.com. The contact for any matter related to these Terms is the same address.
2. What ZUMI is (and is not)
ZUMI is a conversational AI wellbeing companion that helps you log meals and workouts, send meal photos for rough calorie and macronutrient estimates, set general weight or wellbeing goals, see a daily tracking balance, set reminders and track patterns over time. It runs as a chatbot on third-party messaging platforms and uses AI models to interpret your messages, photos and voice notes.
ZUMI is not a medical device, a healthcare professional, a registered dietitian, a nutritionist, a therapist, a regulated coach, or any kind of regulated advisor. ZUMI does not diagnose, treat, prevent, or cure any disease, condition, or disorder.
3. Intended purpose
ZUMI's intended purpose is to support general dietary awareness, journaling, and lifestyle reflection. ZUMI is not intended to diagnose, treat, monitor, predict, prognose, prevent, or alleviate any disease, condition, allergy, intolerance, deficiency, or disorder. ZUMI does not constitute medical device software within the meaning of Article 2(1) of Regulation (EU) 2017/745 ("MDR") or Rule 11 of Annex VIII thereto. ZUMI's outputs must not be used as input to any medical, diagnostic, or therapeutic decision.
4. ZUMI is NOT medical, nutritional, or health advice
This is the most important point of these Terms. Read it carefully.
- Information from ZUMI is provided for general informational and entertainment purposes only.
- ZUMI's outputs (including calorie estimates, macronutrient estimates, daily balances, progress indicators, suggestions, tips, transcriptions, summaries and analyses) are heuristics generated by AI and formulas and may be inaccurate, incomplete, biased, or out of date.
- You must not rely on ZUMI to make decisions about your health, diet, allergies, medications, supplements, pregnancy, eating disorders, or any clinical condition.
- Always consult a qualified physician, registered dietitian, pharmacist, or other healthcare professional before changing your diet, treatment, or routine.
- If you are experiencing a medical emergency, call your local emergency number immediately. ZUMI is not designed to detect, prevent, or respond to emergencies.
- If you have, or suspect you have, an eating disorder, please seek qualified clinical help. ZUMI is not a tool for managing eating disorders. In Italy, you may reach the Numero Verde SOS Disturbi Alimentari (Istituto Superiore di Sanità): 800 18 09 69.
5. About calorie estimates, goals, daily balance and workouts
Text logs are not nutrition measurements. When you describe a meal in text or voice, ZUMI may log what you said as a descriptive food entry. ZUMI should not infer calories or macronutrients from a text-only description unless you explicitly provide those numbers. If you want ZUMI to estimate calories or macros for a meal, you should send a meal photo.
Photo-based calorie and macronutrient estimates. When you send a meal photo, ZUMI may estimate the energy (calories) and macronutrients of the visible meal. These are rough, AI-generated approximations based on what the model believes it sees, typical portion sizes and typical food composition. They can be substantially wrong: ZUMI can miss ingredients, confuse one food for another, misjudge quantities, fail to see hidden ingredients, or misunderstand how the food was prepared. They are not nutritional measurements and are not a substitute for weighing food, lab analysis, professional advice, or your own judgment.
Goals, energy targets and daily balance. If you choose to set a goal (for example losing, maintaining, or gaining weight) and provide body data (age, biological sex, height, weight and activity), ZUMI estimates your maintenance energy needs using the Mifflin-St Jeor formula and a population-level activity multiplier. For weight-loss or weight-gain goals, ZUMI also uses the amount you want to lose or gain and the timeline you provide to estimate a daily tracking target. These figures are generic estimates, not personalized prescriptions. They may be shown in chat and in the dashboard as an approximate daily budget, remaining balance, progress bar or goal-alignment signal.
Workout calories. ZUMI may log workouts you tell it about. Calories burned are stored only if you explicitly state them or they come from a connected import. If workout calories are available, ZUMI may add them to the daily tracking balance as an informational workout credit. This does not mean the number is accurate or that you should eat, restrict, or exercise in any particular way.
No prescription. Any target, balance, label, progress bar, comment or dashboard indicator is general lifestyle reflection, not dietetic, nutritional, medical or coaching advice. ZUMI does not take into account your medical history, medications, pregnancy, eating-disorder history, allergies beyond what you tell it, or any clinical condition.
Safety limits. ZUMI applies conservative safety floors (it will not set a daily energy target below widely-used minimums) and will decline to configure a weight-loss goal where this would be inappropriate (for example a body-mass index below 18.5). Before starting any weight-loss or weight-change plan you should consult a qualified professional, and you should not use goal features if you are pregnant or breastfeeding, are a minor, have a history of an eating disorder, or have a medical condition or take medication affected by diet. In these cases ZUMI is not the right tool and you should rely on a physician or registered dietitian.
6. Eligibility
You must be at least 16 years old to use ZUMI and have the legal capacity to enter into a contract. By using ZUMI you represent that you meet these requirements and that any data you share is yours, or that you have the right to share it. ZUMI is not directed at, and may not be used by, minors under 16.
7. Your account and identity
ZUMI identifies you through your messaging-platform account (for example your WhatsApp phone number or Telegram user ID) and, for the dashboard, through a magic link and signed session cookie. You do not create a separate password with us. You are responsible for:
- Keeping access to your messaging account secure.
- The content you send to ZUMI.
- Not impersonating another person.
- The lawfulness of your use of the service.
8. Acceptable use
You agree not to use ZUMI to:
- Violate any law, regulation, or third-party right (including IP and privacy rights).
- Send content that is illegal, harassing, hateful, defamatory, threatening, sexual involving minors, or otherwise harmful.
- Submit content of others without their consent.
- Attempt to reverse-engineer, decompile, scrape, abuse, overload, fingerprint, or interfere with the service or any of its underlying providers.
- Bypass authentication, rate-limits, signature verification or any security measure.
- Make decisions about other people, hiring, lending, insurance, credit, immigration, healthcare, legal, or any high-stakes automated decision-making based on ZUMI's outputs.
- Use ZUMI to give medical, nutritional, legal, or financial advice to anyone else.
- Resell, sublicense, redistribute or commercially exploit ZUMI or its outputs without our prior written permission.
- Train competing AI models on ZUMI's outputs.
We may suspend, throttle or terminate access at our sole discretion if you breach these rules, or if your activity poses a risk to ZUMI, its providers, or other users.
9. Your content and license to operate the service
You retain ownership of the content you send to ZUMI (text, photos, voice notes). To operate the service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, transmit, transcribe, analyze, transform, cache and display your content solely for the purpose of providing and improving the service to you. We do not sell your content. We do not use your content to train third-party foundation models for general use.
10. AI-generated content and accuracy
ZUMI's responses and analyses are generated by AI models supplied by third parties (currently DeepSeek and Google Gemini, accessed via OpenRouter) together with deterministic formulas used for energy targets and daily balance. You are interacting with an AI system. Such content may be inaccurate, incomplete, hallucinated, out of date, or biased, and does not account for your individual medical context. You are solely responsible for any decision you make based on ZUMI's outputs. We make no warranty of accuracy, fitness, completeness, or non-infringement.
11. Service availability, beta status, changes
The service is provided "as is" and "as available". During the private beta we explicitly do not guarantee:
- Uptime, latency, or any service-level commitment.
- That the service will be free of bugs, errors, or security vulnerabilities.
- That data will be preserved indefinitely. Beta data may be reset, migrated, or deleted as the architecture evolves.
- That past behavior, estimates, targets, dashboard indicators, check-in behavior, or features will remain stable.
We may modify, suspend or discontinue the service (or any feature) at any time, with or without notice, with no liability to you. We may introduce paid features in the future, in which case we will notify you in advance.
12. Privacy
The way we handle your data is described in our Privacy Policy, which is part of these Terms.
13. Third-party platforms and providers
ZUMI runs on top of third-party messaging platforms (WhatsApp, Telegram, and potentially iMessage in the future) and depends on third-party infrastructure and AI providers (including Cloudflare, Supabase, OpenRouter, DeepSeek, Google, Meta/WhatsApp and Kapso). Your use of those platforms is governed by their own terms and privacy policies. We are not responsible for the availability, security, content moderation, or behavior of those third parties. Outages or changes on those platforms may affect ZUMI without notice.
14. Intellectual property
The ZUMI name, logo, brand assets, website, software, prompts, system instructions, and all related materials are owned by ZUMI and protected by intellectual property laws. You receive a limited, personal, non-exclusive, non-transferable, revocable license to use the service for personal, non-commercial purposes during the beta. No other rights are granted, expressly or by implication.
15. Disclaimers
To the maximum extent permitted by applicable law:
- ZUMI is provided "as is" and "as available", without warranties of any kind, whether express, implied, statutory, or otherwise. We disclaim warranties of merchantability, fitness for a particular purpose, accuracy, reliability, availability, security, non-infringement, and quiet enjoyment.
- We do not warrant that the service will meet your requirements, will be uninterrupted, timely, secure, error-free, or that defects will be corrected.
- Any content or material you obtain through ZUMI is at your own discretion and risk.
16. Limitation of liability
To the maximum extent permitted by applicable law:
- In no event shall ZUMI, its operator, contributors, or providers be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, revenue, data, goodwill, business opportunity, or substitute service costs, arising out of or relating to the service or these Terms, even if advised of the possibility.
- The aggregate liability of ZUMI for direct damages, where liability cannot be excluded, is limited to the greater of (i) the amount you paid to use ZUMI in the 12 months preceding the event giving rise to the claim, or (ii) €50. During the private beta, the service is provided free of charge, so this cap will normally resolve to €50.
- Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable mandatory law (such as liability for death or personal injury caused by gross negligence or wilful misconduct, or non-waivable consumer rights).
17. No reliance, no professional relationship
Use of ZUMI does not create any patient-doctor, dietitian-client, lawyer-client, fiduciary, advisory, or professional relationship between you and ZUMI. You acknowledge that you are not relying on any statement made by ZUMI for any decision having legal, financial, medical, or safety consequences.
18. Indemnity
You agree to defend, indemnify and hold harmless ZUMI, its operator, contributors and providers from and against any claim, demand, loss, damage, cost or expense (including reasonable legal fees) arising from: (i) your breach of these Terms, (ii) your misuse of the service, (iii) your content, (iv) your violation of any law or third-party right.
19. Termination
You may stop using ZUMI at any time by ceasing to message the bot, blocking it on your messaging platform, or asking us to delete your account. We may suspend or terminate your access at our sole discretion, with or without notice, if you breach these Terms or pose a risk to other users, the service, or third-party providers. Sections 3, 4, 5, 8, 9, 10, 14, 15, 16, 17, 18, 20 and 21 survive termination.
20. Governing law, dispute resolution and jurisdiction
These Terms are governed by the laws of Italy, without regard to conflict-of-laws principles. Mandatory consumer-protection laws of your place of habitual residence will continue to apply where they offer you greater protection. Disputes shall be brought before the competent courts in Italy, save that consumers retain the right to bring proceedings in the courts of their place of habitual residence as provided by mandatory law.
Pre-litigation mediation. Before initiating any judicial proceeding, you agree to attempt mediation through an accredited Italian mediation body (organismo iscritto al registro del Ministero della Giustizia). This step does not affect your right to seek urgent judicial protection, nor your right to bring proceedings in the courts of your habitual residence.
Class action waiver (non-EU users only). To the extent permitted by applicable law and in jurisdictions where such waivers are enforceable, you agree to resolve disputes only on an individual basis and not as part of any class, consolidated, or representative action. This clause does not apply to consumers residing in the European Union, the European Economic Area, the United Kingdom, or any other jurisdiction whose mandatory law prohibits such waivers.
21. Miscellaneous
- Entire agreement. These Terms and the Privacy Policy are the entire agreement between you and ZUMI regarding the service.
- Severability. If any provision is held unenforceable, the rest remains in effect.
- No waiver. Our failure to enforce a provision is not a waiver of our right to enforce it later.
- Assignment. You may not assign these Terms without our consent. We may assign them, including to a future operating entity (e.g. an Italian Srl) once the service exits beta.
- Force majeure. We are not liable for failures caused by events outside our reasonable control.
22. Changes to these Terms
We may update these Terms. The "Last updated" date will reflect the most recent revision. If changes are material, we will inform you through the service or, where applicable, via email. Continued use after changes means you accept the updated Terms.
